When Public officials step over the line

While reading the numerous dictionary definitions of entitlement one can find this elucidation on the word: “The RIGHT” to guaranteed benefits under a government program such as Social Security or other forms of compensation.” A quote that can be found on line makes this statement. “The perception of entitlement brought on by even a small amount of power, can cause generally good people to do generally bad things.” Perhaps it is the combination of these two that brought us to this investigative article. The key phrase here is “the right”. Right does not mean feeling entitled or abusing power and position for advantage.

On April 8^th, 2011 Jennifer McGee consummated a marriage between herself and Donald Anderson, acting elected DA in Lake County California. The marriage took place in South Lake Tahoe. The events leading up to this marriage and what follows is the crux of this investigative report.

Lake County California held elections for several positions in the county over a year ago. One of those positions was for District Attorney and was contested by attorney Donald Anderson, acting DA Jon Hopkins, and attorney Doug Rhodes. On several occasions during the campaigning Mr. Anderson (who won the election to the DA position) paraded around with a women who we now know as Jennifer McGee a girlfriend during this time, Shortly after the close of those elections, a falling out or separation if you will occurred between Don Anderson and Ms. McGee. During this same time frame the now DA Donald Anderson took his oath of office. This “Oath: essentially describes the DA as the highest purveyor of following the law and its conscripts as well as suggesting to the courts punishment for those that do not. Needles to say it is the top position concerning lawful and of course unlawful actions.

Shortly after the new DA Mr. Anderson affected his position Jennifer McGee was given the terrible news that she had cancer. Apparently at the time Jennifer was without insurance, and with a preexisting condition had decided the monetary outlay to cover her cancer was too high and that the ability to secure health insurance coverage was going to be difficult. DA Anderson has told a number of different people directly of the events that followed this diagnosis. Some of these people are choosing to remain anonymous during this phase of the investigation, other individuals who are aware of this situation are Sean Navarro, and Paul Swanson. Mr. Swanson you may recall is the attorney who took over the child custody case for Anathea Danos who was being represented by Don Anderson prior to being elected to the DA position. Several references to Ms. Danos have appeared on local Internet sites, the Lake County Government Watch Blog has had quite a bit of activity in this regard. Ms. Danos has indicated to several people that DA Don Anderson told her directly he was “only marrying Jennifer to get her on the county health care coverage.”

Don Anderson was quoted as saying, “Jennifer approached me concerning my marrying her so that she could be placed on the county health care program through Anthem Blue Cross the counties health insurance provider.” Mr Anderson indicated that he agreed with engaging in this action, and as reported they were married in South Lake Tahoe on April 8^th 2011.

Since the consummation of what legal doctrine calls a “marriage of convenience” their relationship has been described as a “only on paper.” marriage. Don Anderson and Jennifer McGee do not live together, in fact Jennifer lives in Santa Rosa and has been going to college there. Jennifer has been attending the college of Empire Law. In fact there are no reported sightings of Don or Jennifer being seen together since their marriage. Looking deeper into the activities of Ms. McGee, a plethora of questions are raised as to the validity of this relationship and their marriage. Jennifer has kept an ongoing connection with an individual named Mr. Alex Nichelini. Nichelini is self described as a Realtor and investor of various fashions and also resides in Santa Rosa. Jennifer's son is attending Santa Rosa JC. Jennifer and Alex purchased a property in Monte Rio in December of 2010. That “property deal” could be easily described as a mutual property purchase, with no harm done nor contention that it should or should not be connected to the marriage of convenience. However the plot thickens considerably given the following information. One month after Jennifer and DA Anderson were married Jennifer purchased another property in Guernville, the deed can be seen, and as a part of public records a copy of it can be obtained. We have done so. On the paper work Jennifer stated, under penalty of perjury and unlawfully that she is “an unmarried women”.

As of this reporting a number of questions come clearly to the vanguard. Some of those include, is Jennifer's son receiving aid for his college education on the taxpayers dime. In that if the marriage of Jeniffer to Donald is accurately reported, her child due to the inclusion of the DA's salary would preclude him from qualifying for student aid. Is Mr. Anderson aware of this and complicit in this illegal reporting. If Anita Grant, Kelly Cox, BOS members, and others in our local government are aware of this marriage of convenience and have taken no action are they negligent in their duties and responsibilities to the citizens? Is the DA aware of the property transactions and is he looking the other way in this illegal “unmarried” reporting status? California is a community property state, and providing an unmarried status to the loan doc's may be a way of not having Mr. Anderson attached to the property, did Mr. Anderson agree to this reporting? Although in the end the marriage would supersede Ms. McGee's attempt to keep the property solely hers. It also means the DA would be as responsible for the loan and debt as Jennifer. If Jennifer was in such financial distress that she needed coverage on the county health program, how did she manage to qualify for property purchases, fund those down-payments and otherwise qualify for such purchases? The deeper question is what makes a marriage a marriage, and given the circumstances described in this overview would fraud and insurance investigators come to the conclusion that this is only a marriage on paper. In fact would they come to the conclusion that Don Anderson Lake County DA is defrauding the citizens?

The agencies involved in marriage fraud for insurance include Anthem Blue Cross California fraud division, the California Insurance commissioner, as well as reporting it to local LE authorities who at that point are compelled to investigate the potential illegality of the activities. Other entities include the office of legal assistance in health care which is in Ukiah. This situation is even more poignant given the fact that an elected official into the office of highest regard for the law is involved, namely, Donald Anderson our local DA.

The counties Human Resource director is Kathy Ferguson, she administers the health insurance program for county employees and will be sent a copy of this investigative report. A copy of this will also be sent to the county clerk for the BOS for distribution to all BOS members.
